1. Auction yard Hours of Operation: 9:00 A.M. – 5:00 P.M. on Thursday. 9:00 A.M. – 12:00 P.M. on Friday. All persons entering the auction facility must present photo identification.

2. All vehicles sold through Sergeants Towing Auto Auction must be expected to have a mechanical or electrical problem of some type.

3. All Vehicles are sold AS-IS with no warranty expressed or implied as to the condition or drivability of the vehicles. Nor the condition of the title on file with Department of Motor Vehicles (if any). It is the sole responsibility of the buyer to ensure that the vehicle meets his/her requirements before bidding on said vehicle. All sales are final. Subject to the laws and regulations of any appropriate jurisdiction(s).

4. While quantities, descriptions and capacities are believed to be correct, there are no guarantees and Sergeants Towing will not be held responsible for advertising discrepancies or inaccuracies.

5. No claim will be considered for allowance or adjustment or the rescission of any sale based upon failure of the vehicle/property to correspond with any standard expected.

6. All buyers are advised to have all vehicles purchased in the auction towed out of the auction facility. It is the buyers sole responsibility to make sure that the vehicle is legal and in a roadworthy condition before attempting to drive the purchased vehicle on any public right of way.

7. All vehicles must be paid for and the buyer must have a Bill of Sale in hand before a vehicle purchased in the auction will be released to the buyer.

8. Consignment vehicles may be delivered by appointment only. Call the office to set up an appointment time prior to bring the vehicle to the auction facility.

9. All bidders are required to be members in good standing and have all dues and fees paid before participating in the auction. Valid membership card and the photo ID used to register must be presented at the gate in order to enter the auction facility. Members in good standing may bring guests but the guests may not bid on or purchase vehicles and the member assumes all responsibility for the safety and actions of their guest(s). Guest(s) sixteen years of age or older must present photo ID and sign the guest log.

10. Members and /or their guests may not cross any posted boundary line at any time.

11. Only members in good standing will be allowed to place absentee bids. All absentee bids must be submitted via email to lot3@sergeantstowing.com or via fax to (503)283-8948 prior to 8:00 AM the day of the auction. Absentee bids will not be accepted over the telephone. Sergeants Towing Auto Auction reserves the right to cancel any absentee bids for any reason and at any time.

12. Members and/or their guests may not, at any time, remove, tamper, damage or dismantle any vehicle located on Sergeants Towing property. This includes the removal of batteries, stereo’s, trash, or disabling the vehicle in any way. Violators will have their membership revoked without refund and will be subject to arrest and prosecution to the fullest extent of the law.

13. Vehicles will be sold only to the member who made the successful bid on that vehicle.

14. When a member is awarded multiple vehicles in the auction all vehicles must be paid for at the same time. Members will forfeit any vehicle which has not been paid for by 3:00 pm on Friday after the auction as well as any money deposited toward said vehicle.

15. Donation and consignment vehicles may be paid for by Visa or MasterCard; however, a 5% processing fee will be added to the price of the vehicle. All other vehicles may be paid for by Cash, Visa, or MasterCard. No Checks will be accepted.

16. All vehicles must be paid for by 12 P.M. on Friday or there will be a late fee added to the price of the vehicle.

17. All vehicles purchased through the auction must be removed from Sergeants Towing Private Property no later than 12 P.M. on Friday the day after the auction or a storage fee will be due for storage over the weekend. Vehicles left on Sergeants Towing property beyond noon the Monday following the auction will be impounded and fees assessed at the rates currently approved by the City of Portland.

18. No vehicle may be repaired or worked on while on Sergeants Towing Private Property. Any vehicle being repaired will be subject to immediate impound without notice.

19. All children under the age of 12 must be accompanied by an adult at all times or you will be asked to leave.

20. Appropriate clothing is to be worn by all members and guests. This includes but is not limited to: pants, shirt and closed toe shoes. Sandals or “flip flops” will not be allowed.

21. All persons and vehicles entering the auction facility are subject to search. All items being hand carried are subject to search. Bags, backpacks, toolboxes, or any other closed container are not allowed into the auction facility.

22. All vehicles purchased at Sergeants Towing Auto Auction must be titled with DMV prior to the reselling of the vehicle.

23. Sergeants Towing is not responsible for loss or damage to auction vehicles.

24. Sergeants Towing reserves the right to approve or disapprove final transfer of auction vehicles to the successful bidder even after the auctioneer says ‘Sold’.

25. Sergeants Towing is closed on Saturday and Sunday. NO auction business can be conducted on the weekend(s).

26. All rules, Penalties, Fee’s, Charges, and Definitions are subject to change without notice.

27. Sergeants Towing Reserves the Right to Refuse Service to Anyone.

28. Effective June 20, 2005 per House Bill 2114 per OR-DMV requires all Tow Companies and Dealers in the State of Oregon to remove the year registration stickers from the license plate of all passenger vehicles.

Auction fees and charges

Buyers Fee: 10% of the sale price. Applies to any and everything sold at our auction, including but not limited to: cars, trucks, busses, motor-homes, trailers, boats, campers, motorcycles and personal property.

Look Up Fee: $5.00 per vehicle. Applies when a bidder does not know the vehicle auction number of the vehicle(s) purchased at the auction.

Duplication Fee: $5.00 Applies anytime paperwork has to be reprinted because buyer gave office personnel the wrong vehicle number in the auction.

Late Fee: $100.00 per vehicle: Applies to all vehicles not paid for by 12 P.M. on Friday.

Storage Fee: $100.00 for storage over the weekend. Applies to all vehicles that are left on the property of Sergeants Towing after 12 P.M. on Friday after the Thursday auction.

Penalty Fee: $200.00 or 10% of sale price whichever is greater (per vehicle). Applies to any vehicle not paid for by 3:00 P.M. on Friday after the auction. Note: This fee must be paid before the member will be allowed to return to the auction.

Gate Fee: $50.00 per vehicle: applies only with manger approval for an auction vehicle to be released after business hours. Allowances will be few and far between at management’s discretion.

Dumping Fee: $100.00 per incident: Applies when items or vehicle components are removed from a vehicle purchased through the auction without permission from the management.

Dumpster Fee: $100.00: Applies when a buyer wants to empty non-automobile and non-hazardous substances into the dumpster from any type of item sold at Sergeants Towing.

Consignment Fee: $75.00 or 10% of sale price. Applies to all 3^rd party consignment cars being sold through Sergeants Towing Auto Auction.

Donation and

Consignment: May be paid with Visa and MasterCard. There will be a 5% Processing Fee that will be added to the

price of each vehicle paid for by credit card.

Definitions

1. RUNS: Mechanics from Sergeants Towing were able to start the vehicle ONCE during the past week.

On the day of the auction, the vehicle may be out of fuel, have a dead battery or have developed other problems. If you did not hear the car run during the preview time ASSUME IT DOES NOT RUN.

2. DRIVES: Mechanics from Sergeants Towing were able to engage the transmission and move the vehicle FORWARD AND BACKWARD APPROXIMATELY 1 FOOT only. Vehicles are not test driven to check for any other criteria. If you did not see the vehicle move during the preview time ASSUME IT WILL NOT DRIVE.

3. AS IS – WHERE IS:

There is no guarantee, expressed or implied, concerning any vehicle sold through the auction. It is the sole responsibility of the buyer to investigate each vehicle during the Pre-View time only. No exchanges or refunds will be made. All sales are final.

By signing below I herby do affirm that I have read, understand and have been given a copy of the rules, fees, and definitions applicable to the Sergeants Towing Auto Auction. I also agree to follow all of the rules stated on this notice or stated to me verbally by a staff member of Sergeants Towing Inc. I understand that if I violate any of the above stated rules or refuse to follow the instructions of a staff member of Sergeants Towing Inc. I will be asked to leave. I understand that refusal to leave when requested may result in my membership in Sergeants Towing Auto Auction being revoked without refund and may further result in my being removed by the Portland Police Bureau and arrested for Trespassing.
